Introduction

Welcome to Storypics.AI

These Terms and Conditions (the “Terms”) constitute a legally binding agreement between MINDFLUX INNOVATIONS LTD, registration number HE 484249, registrered address at Panteli Michanikou, 4, Egkomi, 2412, Nicosia, Cyprus (“Storypics.AI”, “we”, “us” or “our”) with any individual and/or legal entity (“User”, “you”, “you’re” or “yours”), which has complete and unlimited legal capacity and legal capacity, to use the website https://storypics.ai/ and its functionality (the “Website”).

The moment of acceptance of these Terms is as follows:

• In terms of using the Website, the moment of visiting the Website and/or registration of the User, if registration is required and grants access to certain features of the Website that are not available to the Buyer without registration; and/or
• In terms of the purchase of the Services, the moment when the Buyer makes payment for such Services.

If you do not agree to all of these legal terms and conditions, you are expressly prohibited from entering into the Agreement, must immediately stop using the Website, and may not purchase the Services.

Additional terms and conditions or documents that may be published on the Website from time to time are expressly incorporated into these Terms by reference. At our sole discretion, we reserve the right to change or modify these Terms from time to time. We will notify you of any changes by updating the “Last Updated” date of these Terms, and you waive any right to receive specific notice of each such change.

You must review these Terms periodically to stay informed of any updates. If you continue to use the Website and/or purchase the Services after the date the updated Terms are posted, you will be deemed to have read them and accepted the changes in any revised Terms as you continue to use the Website and/or purchase the Services.

I. What terminology do we use?

In this section, you can find the terminology used in these Terms.

• Account: A User profile on the Website that allows individuals and legal entities to access the features and Services provided by Storypics.AI through the Website and the Platform hosted thereon.
• Parties: Storypics.AI and the User, when referred to together.
• Third Party: Any person or entity other than Storypics.AI and the User.
• Services: All services provided by Storypics.AI to the User through the Website and the Platform are described in Section III of these Terms and/or in other documents on the Website.
• User-generated content: Any content created by the Users of the Platform while using it.
• Website: A group of web pages created using HTML, CSS, JavaScript and other programming languages available via the Internet is located at the following web address: https://storypics.ai/
• Platform: the software and services provided by Storypics.ai, available through the Website, which allow Users to generate text, images, and other creative content using artificial intelligence, as well as to customize, edit, and download such Content. The Platform includes all components, functionality, updates, and any other related features or materials provided by Storypics.ai.
• GDPR: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
• Legislation: Applicable laws and other regulatory acts that regulate legal relations between Storypics.AI and Users.

II. What Services can you get?

Storypics.AI provides Users with access to the Platform for a fee, which allows them to plan the architecture, create and automate code using artificial intelligence for the various needs of Users.

Main services:

Content creation with AI:

• Story generator: Create unique stories, scripts, or narratives tailored to your input using artificial intelligence.
• Image generation: Produce AI-generated illustrations, cover art, or visual content to complement your stories.
• Custom style adaptation: Adjust tone, style, and format of generated text or visuals according to your needs.
• AI editing assistant: Receive suggestions to refine, expand, or improve your text and images.

Functionality for collaboration:

• Team collaboration: Invite collaborators to work together on projects, share drafts, and review generated content.
• Feedback and suggestions: The platform’s AI and collaboration tools help optimize and polish creative results.
• Reports and analytics: Get insights on usage, content performance, and project history.

Quality of services:

• AI guarantees that all services will be performed in a professional manner in accordance with industry standards. Storypics.AI provides uninterrupted access to services 24/7, except during maintenance, system failures, or circumstances beyond Storypics.AI control.
• AI uses the OpenAI APIs, as well as custom processes that optimise the results and tailor them to your projects, input data, and UML. We chose this model because it delivers the best cross-coding language results based on our testing.

Data security:

• AI complies with the requirements of the European Parliament and Council Regulation (EU) 2016/679 (GDPR) on the protection of personal data. We take all reasonable measures to protect your data from accidental loss or destruction, unlawful processing, including unlawful destruction or access to Personal Data.
• Your Content is encrypted and stored securely to ensure confidentiality and data integrity for a period of three years from the date you terminate your use of the Website and/or delete your account.

III. Account registration process

In this section, you can learn about the process of registering accounts on the Storypics.AI platform.

Account registration:

• Login via Google: Storypics.AI allows you to use your Google account to register and log in to the platform. This simplifies the registration process and reduces the number of steps required.
• Account creation: You can create your account through the form available on the Website. You need to fill in the following data: email, password.

Changes to registration information:

The User undertakes to update the information provided during registration in a timely manner in case of any changes. Storypics.AI reserves the right to require the User to confirm the updated information and, in case of incomplete or incorrect information about the User, to suspend or terminate the provision of the Services.

IV. Payment and invoicing

This section contains information about payment and billing processes for Storypics.AI Users.

• Prices for Services are displayed on the Website and are calculated on a pay-per-use basis, which may include charges per word of generated text and per generated image
• Minimum order amount. The minimum payable amount per transaction is €10.00.
• Payment process. Payments must be completed before downloading generated content. Payment processing is handled by third-party providers (e.g., Stripe, PayPal, or other indicated services).
• All transactions are processed in Euro (€) unless otherwise stated.
• Non-refundable. Payments are non-refundable, except where required by applicable law.

V. How are the Services accessed and confirmed?

This section describes how the Services are provided to the Users.

Confirmation of the provision of the Services:

• Confirmation emails: Storypics.AI sends confirmation emails to your provided email address upon completing your registrationor payment. These emails contain information about the transaction details, including the date, amount, and other relevant data.

VI. Rights and obligations of the User

This section describes the rights and obligations of the User of the Website and the Storypics.AI Platform.

User’s rights:

• The User has the right to access all Services and features corresponding to the order paid for on a pay-per-use basis.
• The User has the right to protect their Personal Data in accordance with the Storypics.AI policies posted on the Website and applicable law.
• The User has the right to receive information support from Storypics.AI, including answers to questions, solving technical problems and other forms of support within the framework of the proper provision of the Services.
• The User may cancel the order at any time before completing the payment. Once the payment has been processed and the content has been generated, the order cannot be cancelled and no refunds will be issued, except as required by applicable law
• The User also has other rights provided for the Personal Data subject in accordance with the General Data Protection Regulation.

User’s obligations:

• The User undertakes to provide accurate and up-to-date information when registering and using the Website and the Platform.
• The User undertakes to use Storypics.AI services in accordance with the applicable law and not to violate the rights of other users or Third Parties.
• The User shall be responsible for the protection of their credentials, including passwords, and for all actions performed under their Account.
• The User undertakes to comply with the terms of use of the Website and the Storypics.AI Platform, including the prohibition of the distribution of malicious software and other illegal actions.
• The User is prohibited from modifying, reverse engineering, decompiling or otherwise attempting to extract the source code of the Storypics.AI Platform and from using any elements of the Platform without the appropriate permission.

VII. Restrictions on use

This section describes the restrictions and prohibitions on the use of the Platform and any Content generated through the Storypics.AI Platform.

Prohibited use:

• Any attempts of unauthorised access, hacking, or interference with the Platform, the Website, the network or servers of Storypics.AI, or any other websites.
• Use of the Platform for activities related to gambling, drugs, pornography or any other illegal activity.
• Using the Platform to transmit or store any malware, viruses, Trojan horses or other code that may damage, disrupt or limit the functionality of any software or hardware.
• Using the Platform to commit fraud or deception.
• Using the Platform to distribute unsolicited or bulk electronic messages (spam).

Geographical restrictions:

• The use of the Website and the Platform is prohibited for Users located in the Russian Federation and the Republic of Belarus or having citizenship of these countries.

VIII. Term of the Terms and termination of the Terms by the respective User.

This section describes the period of validity of the Terms between Storypics.AI and the User and the process of their termination.

Expiration date:

• These Terms and Conditions shall enter into force for the respective User by acceptance of them from the moment of registration of the User’s Account on the Storypics.AI Website and shall be valid between Storypics.AI and the respective User as long as the User uses the Storypics.AI Services.

Termination and amendment of the Terms:

• Termination by the User: The User may stop using the Services at any time by discontinuing the placement of new orders. Since payments are made on a one-time basis for each order, there is no ongoing subscription to cancel. After payment is processed, the User retains the right to access and download the Content generated through the Platform. Once the order is completed, no modifications or edits can be made to the generated Content unless a new order is placed.
• Termination by Storypics.AI: Storypics.AI reserves the right to immediately terminate the Terms with the respective User and such User’s access to the Website and the Platform in case of violation of the provisions of these Terms by the User, any illegal actions or actions that may harm Storypics.AI or other u
• Changes to the Terms: Storypics.AI has the right to change these Terms unilaterally. We will notify you of any changes by updating the “Last Updated” date of these Terms.

Consequences of termination of the Terms:

• Upon termination of the Terms, the User will lose access to their Account and all data related to it.
• The User shall not be entitled to a refund of the cost of the Services once payment has been made. The Services are deemed to be provided and consumed at the moment the order is processed and the AI-generated content is delivered.

IX. How can you contact us?

General order:

• If you would like to make an inquiry or send a complaint regarding your use of the Storypics.AI Platform or our Services, you may contact our support team by email at [email protected]
• We strive to deal with all inquiries or complaints as quickly as possible. Our team will provide you with a response within 10 (ten) business days of receiving your query or complaint.

Requests for Personal Data:

• To access your Personal Data or exercise any rights related to data processing, please send a request to i.Please include your name, contact information and specific details in your request.
• The term for reviewing your request for the possibility of its satisfaction is up to ten business days from the date of its receipt. During this period, Storypics.AI will notify you whether the request will be granted or provide grounds for refusing to provide the relevant Personal D
• The request shall be granted within 30 calendar days from the date of its receipt, unless there are grounds for refusal.
• If the required Personal Data cannot be provided within 30 calendar days from the date of receipt of the request, the deadline may be extended. In this case, the total period for resolving the issues raised in the request will not exceed 45 calendar days.

All inquiries and complaints you submit will be treated confidentially. We protect your Personal Data in accordance with our Privacy Notice and applicable law.

X. Intellectual property rights

This section describes the intellectual property rights relating to the use of the Website, the Storypics.AI Platform and the Content created by Users.

Storypics.AI intellectual property rights

• All intellectual property rights in and to the Storypics.AI Website and Platform, including software, computer code, all text, graphics, user interfaces, visual interfaces, photographs, trademarks, designs, logos, musical compositions, and other works contained on the Website and the Platform (collectively, the “Intellectual Property”) is owned, managed and controlled by Storypics.AI or its licensors and are protected by copyright, patent, trademark and other intellectual property laws.
• At the same time, the API OpenAI and other tools used by Storypics.AI to generate code are not Storypics.AI intellectual property. These tools are owned and operated by OpenAI in accordance with their terms and licences. Storypics.AI uses these tools to improve the functionality of its Platform, but does not own the rights to the OpenAI APIs or their models.
• AI may take measures to protect its Intellectual Property rights. In particular, to file: lawsuits, requests for content removal and other legal actions.

Licence to use Storypics.AI

• AI grants Users a non-exclusive, revocable, limited licence to access and use the Platform for personal or internal business purposes in accordance with these Terms.
• This licence does not allow Users to reverse engineer, decompile or otherwise attempt to extract the source code of the platform; use the Platform in any way that infringes the intellectual property rights of Storypics.AI or Third Parties, including the intellectual property rights of OpenAI.

Intellectual property rights of OpenAI

• The Storypics.AI Platform uses the OpenAI API to generate code using artificial intelligence.
• All rights to the OpenAI APIs, their models, algorithms, and related software are exclusively owned by OpenAI and are governed by their Terms of Use. Storypics.AI does not own the intellectual property of these tools and does not claim any rights to them.

Intellectual property rights of the Users:

• Users may provide input data to the Platform (“Input Data”) and receive a result generated on the basis of this data (“Output Data”). Input and Output Data are part of the Content created by the User. The User is responsible for the Content, including its compliance with applicable law and these Terms. The User warrants that it has all rights, licences and permissions necessary to provide the Input Data to the Platform.
• Users retain intellectual property rights to all Content, including codes, diagrams, texts and other materials, Input and Output on the Storypics.AI platform.
• At the same time, due to the nature of artificial intelligence and its operation, the Inputs may not be unique, and other users may obtain similar results from using the Platform. The User’s ownership does not extend to the Inputs received by other users or to the Inputs owned by Third Parties.

Zero tolerance policy:

Storypics.AI implements a zero-tolerance policy for violations of intellectual property rights and takes all necessary measures to prevent such violations.

XI. Limitation of liability

• AI shall not be liable for any damages that may result from the use of, or the inability to use, the Storypics.AI Platform. This includes, but is not limited to, damages for loss of profits, business interruption, loss of programs or other information.
• AI is not responsible for any technical problems of the Platform that may cause temporary unavailability of services or loss of data. Storypics.AI makes every effort to ensure the uninterrupted operation of the Platform but cannot guarantee the absence of technical failures.

Limitation of liability for Third Party services:

• The Storypics.AI Platform may contain links to or integrations with Third Party services. Storypics.AI is not responsible for the quality, content, security or legality of the services and information such Third Party services provide.
• By using Third Party services through the Platform, Users do so at their own risk and must comply with such services’ terms of use and privacy policies.

Limitation of liability for the actions of Users:

• AI is not responsible for Users’ actions that violate Terms, including illegal actions: fraud, distribution of malicious software or violation of intellectual property rights.
• Users are solely responsible for the Content they create and upload to the P Storypics.AI reserves the right to remove Content that violates the Terms or the Legislation.

Force majeure circumstances:

• AI shall not be liable for any failure to perform or delay in performing its obligations under these Terms if such failure or delay is caused by force majeure, including but not limited to natural disasters, acts of war, acts of terrorism, legal restrictions, lack of power, technical failures, or other circumstances beyond the control of Storypics.AI.

XII. Warranties and limitations

• AI does not warrant the accuracy, completeness, currency or reliability of any Content posted on the Platform. All information posted on the Platform is provided “as is” and “as available” without warranty of any kind.
• AI does not warrant that the Platform will be uninterrupted, error-free or free of technical failures. We make every effort to ensure the uninterrupted operation of the Platform but cannot guarantee that there will be no failures or temporary interruptions in operation.

XIII. Legislation governing the Terms and Conditions

• These Terms shall be governed by and interpreted in accordance with the laws of Cyprus. All disputes arising in connection with these Terms shall be resolved in the courts of Cyprus.
• The Parties undertake to comply with all laws and regulations of Cyprus, including, but not limited to, laws on personal data protection, e-commerce and intellectual property.
• All relations between the parties not regulated by these Terms shall be governed by the relevant Legislation.

XIV. Additional conditions

This section describes the annexes (policies) that regulate the relationship between Storypics.AI and Users and are integral parts of these Terms.

Privacy Notice:

• The Privacy Notice contains information on how Storypics.AI collects, uses, stores and protects Users’ Personal Data.
• All Users are required to read the Privacy Notice before using the Website, registering and making payments for Services.

Cookie Notice:

• The Cookie Notice contains information on how Storypics.AI uses cookies and other technologies to collect information about Users when they visit the platform.

XV. Final provisions

• These Terms and Conditions and their annexes constitute the entire agreement between Storypics.AI and the User regarding the use of the Storypics.AI platform. All previous contracts and agreements between the parties, both oral and written, are cancelled and replaced by these Terms.
• If any provision of these Terms is found to be invalid or unenforceable, the validity or enforceability of the remaining provisions of these Terms will not be affected. The invalid or unenforceable provision will be replaced by another provision closest to the original one.
• The User may not transfer its rights or obligations under these Terms to other persons without the prior written consent of Storypics.AI. Storypics.AI may assign its rights and obligations under these Terms to any affiliate.
• These Terms may be available in several languages for the convenience of the Users. In case of discrepancies between versions in different languages, the English version shall prevail.
